Terms and Conditions

  1. The competition begins 21/10/2009 and closes 31/01/2010.
  2. The competition is open to persons over the age of 18 years who are not employees of the Promoter, competition sponsors and their related bodies corporate and their immediate families.
  3. By entering this competition the entrant accepts and agrees to be bound by these terms and conditions governing the competition.
  4. To be eligible to enter this competition individuals are required to be a HotelClub Member or register to become a new HotelClub Member by completing the online registration form during the promotion period. For the entry to be valid the online competition entry form must be completed and all registration details must be valid. HotelClub reserves the right to reject any registration not validly completed without notice to the entrant. Individuals who complete and submit an online registration form will be deemed to accept and be bound by these terms and conditions.
  5. This is a game of skill and chance plays no part in determining the winner. The Promoter’s decision is final and no correspondence will be entered into.
  6. The winners of the three main prizes will be determined on 01/02/2010 according to the highest three scores validly registered at that time. The winners will be notified by email. If HotelClub does not receive acknowledgement from the winner by 08/02/2010, the original winner will be deemed to have forfeited their prize and shall have no further claim in relation to this promotion. A new winner shall be chosen from the remaining entries based on the next highest validly entered score.
  7. The confirmed competition winners will be announced on the website by 19/02/2010 and notified via email.
  8. Prize: Each of the three winners will receive a prize of seven nights accommodation in any hotel found on hotelclub.com valued at a maximum of US$2500. This amount will be credited to their member account in Member Dollars (converted in US dollars). Should the winner select accommodation with a higher value than US$2500 the prize winner must pay the balance. The prize includes the booking of accommodation only and does not include associated expenses such as transfers, room service, in-house movies etc.
  9. The prize is not transferable or redeemable for cash. The prize must be redeemed within 12 months of the winner being notified and all stays must be completed within this period
  10. If for any reason beyond the control of the Promoter this competition is not capable of running as planned and the administration of this competition is affected, the Promoter reserves the right to cancel, terminate, modify or suspend the competition subject to relevant lottery legislation requirements.
  11. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. If the Promoter believes that a person is deliberately manipulating entries into this promotion, or if the Promoter believes that an entrant has recorded scores by engaging in computer hacking or conducting behaviour against the skill based spirit of the promotion, the Promoter may exclude such person from this promotion.
  12. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
  13. The Promoter shall not be liable for any loss, damage or loss of profit (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained, as a result of participating in the game and or taking of any the prizes, except for any liability which cannot be excluded by law. In accepting the prize, the recipient may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  14. Winners and guests are responsible for having valid passports (and visas, as applicable), travel insurance and spending money. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The prizes are not transferable, exchangeable or redeemable for cash. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. The Promoter shall have no responsibility for obtaining travel permits for winners and any and all costs associated with obtaining such permits (including visas) shall be the responsibility of the prize winner.
  15. Any taxes (other than GST) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the prize winner.
  16. If participants check the opt-in box “I would like to receive special offers from HotelClub.com” the personal details of the entrant will be used for future promotional purposes (including electronic messaging) without any payment or other compensation to the entrant. Entrants have the right to access and correct personal information and can do so by contacting the Promoter.
  17. The Promoter reserves the right to change the terms & conditions of the competition at any time without notifying entrants.
  18. The Promoter is Flairview Travel Pty Limited ABN 85 092 445 442 trading as Hotelclub, Level 29, 680 George Street SYDNEY NSW 2000.
  19. These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia. All entrants submit to the non-exclusive jurisdiction of the courts of New South Wales.
