HOTELCLUB HOTEL AWARDS SURVEY AND COMPETITION
TERMS AND CONDITIONS

 

DURATION
1. The competition begins 15th June 2009 and closes 31st July 2009. Entries shall be accepted until midnight (AEST) of the closing date.

ENTRY
2. Sponsors of the competition include: Virgin Blue and AsiaOne.

3. Entry is free and the competition is open to all individuals over the age of 18 years, with internet access, except employees of the Promoter, competition Sponsors and their related bodies corporate and their immediate families. Some prizes may have additional age restrictions.

4. To enter, individuals must correctly complete the online entry form during the promotion period. For the entry to be valid all steps must be completed and personal information must be provided. Individuals who complete and submit an online registration form to enter the competition will be deemed to accept and be bound by these terms and conditions.

5. The winners will be chosen based on the reasons provided for their “Perfect Hotel”. Each entry will be individually judged based on creative merit. Entries must be the original, independent creation of the entrant and free from any third party claims, including copyright or trademark claims. Entries must not: (i) have been published previously; (ii) have won prizes or awards in another competition or; (iii) contain information that is discriminatory, defamatory, and offensive or infringes any law or regulation. This is a game of skill and chance plays no part in determining the winner.

6. The entrant consents to the Promoter, its related companies and the competition Sponsors using comments made on the survey form, including placing such comments on its websites or third party websites. Unless expressly requested by the entrant to do so we may not acknowledge your authorship when posting comments.

INFORMATION ON PRIZES
7. Prize winners will be selected by the promoter on 4th August 2009 at Level 29, 680 George Street, Sydney, NSW 2000. Winners will be notified in writing and the winners’ names will be published on the www.hotelclub.com/hotel-specials/BestHotels2009 website by the 20th August 2009. It is a condition of awarding each prize that the winner must, if requested to do so by the Promoter, sign and return any affirmation of eligibility to enter, ownership of entry, or release and compliance statements provided to the winner by the Promoter. Prizes not claimed within 90 days of the date of the notification of the result of the competition will be deemed as “unclaimed” and the Promoter will select replacement winners from the remaining eligible entries for each Unclaimed Prize based on the creative merit of the description of their “Perfect Hotel”. This process shall be repeated until the Promoter has selected confirmed winners for all prizes.

8. Prizes are not transferable and cannot be exchanged for cash.

9. Three prize winners will be chosen by the judges based on the reasons provided for their “Perfect Hotel” after voting in Best Hotels Survey and completing the online entry form. The judges’ decision is final and no correspondence will be entered into.

10. First Prize: One entrant with the best entry as decided by the judges will receive USD$ 5,000 worth of HotelClub accommodation to be used during one Travel Event, as defined by the Promoter in its sole discretion. The accommodation will be booked directly by the Promoter (i.e. not by the winners). Should the main accommodation stay value be less than the total prize value (AUD $5,000) – the remainder (up to a maximum of 25% of the total value = USD$ 1,250) will be given as member dollars on the winner’s HotelClub member account. Should the main accommodation selected by the winner be more than the total prize value the prize winner must pay the balance. Member dollars must be used in accordance with the terms and conditions set out on http://www.HotelClub.com/common/membership/MemConditions.asp, and cannot be redeemed for cash.

11. Second Prize: One entrant with the next best entry as decided by the judges will receive USD$ 3,000 worth of HotelClub accommodation to be used during one Travel Event, as defined by the Promoter in its sole discretion. The accommodation will be booked directly by the Promoter (i.e. not by the winners). Should the main accommodation stay value be less than the total prize value (AUD $3,000) – the remainder (up to a maximum of 25% of the total value = USD$ 750) will be given as member dollars on the winner’s HotelClub member account. Should the main accommodation selected by the winner be more than the total prize value the prize winner must pay the balance. Member dollars must be used in accordance with the terms and conditions set out on http://www.HotelClub.com/common/membership/MemConditions.asp, and cannot be redeemed for cash.

12. Third Prize: One entrant with the next best entry as decided by the judges will receive USD$ 2,000 worth of HotelClub accommodation to be used during one Travel Event, as defined by the Promoter in its sole discretion. The accommodation will be booked directly by the Promoter (i.e. not by the winners). Should the main accommodation stay value be less than the total prize value (AUD $2,000) – the remainder (up to a maximum of 25% of the total value = USD$ 500) will be given as member dollars on the winner’s HotelClub member account. Should the main accommodation selected by the winner be more than the total prize value the prize winner must pay the balance. Member dollars must be used in accordance with the terms and conditions set out on http://www.HotelClub.com/common/membership/MemConditions.asp, and cannot be redeemed for cash.

13. The total prize pool is valued at up to USD$10,000. Prizes’ value subject to change and neither the Promoter nor the Sponsors will be liable to change prizes or pay any compensation due to changes in value.

14. If for any reason beyond the control of the Promoter this competition is not capable of running as planned and the administration of this competition is affected, the Promoter reserves the right to cancel, terminate, modify or suspend the competition.

15. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. If the Promoter believes that a person is deliberately manipulating entries into this promotion, the Promoter may exclude such person from this promotion.

16. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.

17. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.

18. The Promoter reserves the right to seek damages to the fullest extent permitted by law for any deliberate attempt to damage any website or the information on a website, or to otherwise undermine the legitimate operation of this competition.

19. The Promoter shall not be liable for any loss, damage or loss of profit (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained, as a result of participating in the game and or taking of any the prizes, except for any liability which cannot be excluded by law. In accepting the prize, the recipient may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

20. The Promoter makes no representations or warranties as to the quality, suitability, merchantability of any goods and services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to a person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission deliberate or negligent, by the Promoter or its servants or agents, in connection with the arrangement for supply, or the supply of any goods or services by any person to the prize winner and, where applicable to any family or persons accompanying a winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again. Winners and guests are responsible for having valid passports, travel insurance and spending money. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The prizes are not transferable, exchangeable or redeemable for cash. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the prize winner.

21. If the personal information requested by the Promoter on the survey entry form is not fully completed a person may not participate in the competition.

22. Unless otherwise advised, upon entering the competition each entrant accepts that the Promoter and its related corporate bodies may use information provided on the entry form for future promotional, marketing or publicity purposes (including electronic messaging) without any payment or other compensation to the entrant. If participants check the opt-in box the personal details of the entrant will be shared with the competition sponsors. Entrants have the right to access and correct personal information, or request that their information is not provided to third parties and can do so by contacting the Promoter.

23. Each entrant agrees and confirms that before giving the Promoter personal information of any other person besides themselves they have obtained the consent from the other person to provide such information. The Promoter accepts no responsibility for an entrant’s failure to obtain a third party’s consent to provide their personal information to us. The Promoter will advise any such third party how it obtained their details.

24. Entrants consent to the use of their personal information by the Promoter, its related bodies corporate and the competition sponsors for marketing and promotional purposes in accordance with these terms and conditions. These terms supplement the HotelClub Privacy Policy and shall apply to the extent of any inconsistency.

25. The Promoter reserves the right to change the Terms & Conditions of the competition at any time.

26. The Promoter is HotelClub (ABN 85 092 445 442), Level 29, 680 George Street SYDNEY NSW 2000.

27. These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia. All entrants submit to the non-exclusive jurisdiction of the courts of New South Wales.
