Travel Agent Account Terms and Conditions

HotelClub – for Travel Agents

Access to and use of HotelClub – for Travel Agents is subject to acceptance of the terms and conditions below (“Terms and Conditions”). By accessing, using or obtaining any content, products or services through HotelClub – for Travel Agents, you agree to be bound by these Terms and Conditions.

Terms and Conditions

The following HotelClub - for Travel Agents terms and conditions constitute terms and conditions that apply to the products and services made available through HotelClub – for Travel Agents. These Terms and conditions are in addition to all other applicable terms and conditions displayed on www.hotelclub.com (“HotelClub Website”) including but not limited to HotelClub’s Booking Terms and Conditions, Terms of Use, Privacy Policy, suppliers’ terms and conditions and are subject to change without notice.

HotelClub – for Travel Agents

All products and services made available through HotelClub - for Travel Agents are being sold to you directly by the supplier of those products and services ("Hotel") and not HotelClub - for Travel Agents. A Hotel is s hotel, or other provider of products or services. In addition to Terms and Conditions, your reservations are also governed by the terms and conditions of the respective Hotels. Any claims that you may have with regard to the products and services reserved through HotelClub - for Travel Agents must be addressed to the Hotel and not HotelClub - for Travel Agents. You expressly release HotelClub - for Travel Agents from any and all liability for, resulting from, arising out of, or in any way connected to, any products or services reserved through HotelClub - for Travel Agents.

You agree to abide by the terms and conditions set by the Hotel, including, but not limited to, observation of check-in/check-out times and compliance with all terms and conditions related to products, or services.

HotelClub - for Travel Agents Rates and Availability

A travel agent registered with HotelClub - for Travel Agents will gain access to discounted hotel rates ("Net Rates"). The Net Rates offered to travel agents are not offered on the HotelClub Website to the public.

To access these Net Rates and make hotel reservations using these rates, the travel agent must login to HotelClub Website with the Travel Agent ID and Password issued by HotelClub. If the travel agent does not login, the agent will not be entitled to book using the Nett Rates.

All bookings made by the travel agent, using the Travel Agent account issued by HotelClub, are subject to the Booking Conditions specified by HotelClub.

Should the travel agent wish to book a hotel room using the Net Rates through HotelClub – for Travel Agents, on behalf of his/her customer at a profit, the travel agent is able to "mark up" the Net Rate. In this event, the travel agent should use the travel agents’ credit card to process the transaction through the HotelClub – for Travel Agents’ site based on the Net Rate and then accept payment from his/her customer for the total room charged by the Travel Agent being the Net Rate and the mark up. The amount payable to HotelClub will always be equal to Net Rates.

The HotelClub - for Travel Agents’ rates, information, and taxes are subject to change without notice.

PRICES ARE NOT GUARANTEED UNTIL THE PRODUCT OR SERVICE HAS BEEN PAID IN FULL, AND YOU RECEIVE A CONFIRMATION E-MAIL MESSAGE THAT THE RESERVATION HAS BEEN COMPLETED.

Exclusions and Additional Charges

Unless otherwise expressly listed, the Net Rates on HotelClub - for Travel Agents do not include items such as meals, shows, tours, gratuities, telephone calls, cribs, rollaway beds, laundry, guest incidentals at hotel or other items of a personal nature not otherwise specified in the quoted rates. Rates may also exclude some fees and surcharges such as resort fees and energy surcharges.

Payment

Payment in full must be made with the Travel Agents’ credit card at the time of booking. You authorize HotelClub - for Travel Agents to charge the credit card that you provide for the total amount of the reservation including fees, taxes, shipping/handling and other charges and surcharges displayed at the time of booking.

Discounts and Promotions

Except for promotions specifically offered for or by HotelClub - for Travel Agents, no other promotional discounts, upgrades, vouchers, coupons, frequent traveler awards, gift certificates or other discounts or special offers apply to products or services made available through HotelClub - for Travel Agents.

Cancellations and Changes

For hotel reservations, suppliers may charge fees when you change or cancel a hotel reservation.

Hotel

Hotel property amenities are subject to change without notice and at the discretion of the hotel. Hotel photos are representative only and do not necessarily depict the actual room in which guests will be accommodated. Minimum age restrictions may apply for check-in. You must be at least 21 years of age to check-in at a Las Vegas hotel. To check into a hotel, there must be at least 1 adult over the age of 18 per room, except where state law provides otherwise.

Possible Changes in Service

If the Hotel notifies us of changes in the service or availability, we will use our good faith efforts to notify you. If a change in the service occurs within 24 hours of the hotel reservation, we will use our good faith efforts to notify you and/or the customer of the changes by phone. Notification of changes occurring more than 24 hours before the scheduled reservation will be by e-mail.

HotelClub - for Travel Agents is not liable for any changes in the reservation that are beyond its control or are caused by, due to, or are attributable to the Hotel.

Age Restriction

Minors (as defined under the laws of their jurisdiction or residence) are not eligible to use HotelClub - for Travel Agents or reserve products or services made available through HotelClub - for Travel Agents. Hotels are independent contractors, and not agents or employees of HotelClub - for Travel Agents.

Liability

By using HotelClub - for Travel Agents, you waive any claim against HotelClub - for Travel Agents, its parent and any of its affiliates or any of their officers, directors, agents, contractors or employees and expressly agree that neither HotelClub - for Travel Agents, its parent nor any of is affiliates, nor any of their officers, directors, agents, contractors or employees, shall be held liable for a) any loss of or damage to property or injury to any person caused by reason of defect, negligence, or other wrongful act of omission of, or any failure of performance of any kind by any Hotel; b) any inconvenience, loss of enjoyment, mental distress or other similar matter; c) any substitutions of accommodations, terminations of service, or changes in fares and rates;d) any cancellation or double booking of reservations beyond the reasonable control of HotelClub - for Travel Agents; and e) any claim of any nature arising out of or in connection with air or other transportation, services, or other features performed or occurring in connection with any product or service made available by HotelClub - for Travel Agents.

Changes to Terms and Conditions

HotelClub may change HotelClub - for Travel Agents Terms and Conditions from time to time with or without prior notice.

HotelClub also reserves the right to terminate HotelClub - for Travel Agents, or any part thereof, in any jurisdiction, at any time with or without notice. HotelClub is not liable to Travel Agents in any way for any value or benefits Travel Agents may lose as a result of any changes made to HotelClub - for Travel Agents.

It is the responsibility of Travel Agents to check the HotelClub - for Travel Agents website regularly for any changes to the Terms and Conditions. Continued use of the program by the Travel Agent will be deemed as acceptance of the current Terms and Conditions.

Miscellaneous

Travel Agent membership is not transferable to another individual or organization. HotelClub reserves the right to suspend or revoke a travel agent registration without notice.

Nothing in these Membership Terms and Conditions affects any rights a Member may have and which by law cannot be excluded, including under the Trade Practices Act (1974) and under State and Territory consumer protection legislation.

If part or all of any clause of these Membership Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Membership Terms and Conditions will continue to have full force and effect.

These Terms and conditions have been made in, and shall be construed in accordance with the laws of the state of New South Wales, Australia. By using HotelClub - for Travel Agents you consent to the exclusive jurisdiction and venue of the state and federal courts in New South Wales Australia, in all disputes arising out of or relating to these Terms and conditions.
